MILEVA PROJECT - TERMS AND CONDITIONS

1. Introduction and Acceptance of Terms
These Terms and Conditions (these "Terms") govern your access to and use of the website (the "Site") operated by Mileva Project, an Illinois non-profit organization (the "Organization," "we," "our," or "us"), and your participation in any programs offered by the Organization (collectively, the "Programs"). By accessing or using the Site, submitting any information through the Site, or participating in any Program, you ("you" or "User") acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue use of the Site and not participate in any Programs. If you are a parent or legal guardian submitting information on behalf of a minor child (an "Applicant"), you represent and warrant that you have the legal authority to do so and that you agree to these Terms on behalf of yourself and the Applicant.
2. Mission and Purpose of the Organization
The Organization's mission is to engage and educate minor children from the Serbian diaspora in the United States to their culture and heritage by facilitating visits to Serbia. The Organization accomplishes this mission by awarding travel cost assistance to selected minor children (to be accompanied by their parent or legal guardian) (collectively, "Participants") through annual selection processes.
3. Scope of Organizational Support
The Organization's role is solely to provide financial support toward eligible travel costs for Participants selected through the Organization's Programs. The Organization does not operate as a travel agency, tour operator, or travel service provider. The Organization does not guarantee, arrange, coordinate, manage, or undertake any obligation whatsoever regarding:
(a) the safety, health, well-being, or physical security of any Participant at any time, whether during travel, while in Serbia, or otherwise;
(b) the supervision, care, or oversight of any minor child or accompanying parent or guardian;
(c) the quality, reliability, or suitability of any transportation, lodging, meals, activities, excursions, or other travel-related services;
(d) compliance with any local, national, or international laws, regulations, customs, or requirements applicable to travel or entry into any jurisdiction; or
(e) any acts, omissions, negligence, or misconduct of any Participant, third party, vendor, service provider, government entity, or other person or organization.
Each Participant, and the parent or legal guardian of each minor Applicant, acknowledges and agrees that the parent or legal guardian shall at all times retain full and sole responsibility for the supervision, safety, care, and well-being of the minor child during any travel or activities associated with the Program.
4. Application and Selection Process
4.1 Submission of Applications
Parents or legal guardians of minor children of the Serbian diaspora may submit application information through the Site for consideration in the Organization's annual selection process. By submitting an application, the submitting parent or guardian represents and warrants that all information provided is true, accurate, and complete.
4.2 No Guarantee of Selection
Submission of an application does not guarantee, entitle, or create any right to selection for participation in any Program. The Organization conducts its selection process on an annual basis through a draw or such other method as the Organization may determine in its sole and absolute discretion. The number of Participants selected each year, if any, shall be determined by the Organization in its sole discretion based on available resources and other factors the Organization deems relevant.
4.3 Right to Remove or Disqualify
The Organization reserves the right, in its sole and absolute discretion, to remove, disqualify, or revoke the selection of any Applicant or Participant at any time, for any reason or for no reason, including but not limited to: (a) discovery of inaccurate, incomplete, or misleading information in the application; (b) failure to comply with these Terms or any policies adopted by the Organization; (c) conduct that the Organization deems detrimental to the Program, the Organization, or other Participants; or (d) any other reason the Organization deems appropriate. The Organization shall have no liability to any Applicant, Participant, parent, guardian, or any other person in connection with any such removal or disqualification.
4.4 Selection Criteria and Policies
The Organization reserves the right, in its sole discretion, to establish, modify, or revise the eligibility criteria, selection process, rules, and policies governing the Programs at any time. The Organization may adopt additional criteria, including but not limited to age requirements, geographic residency, heritage verification, or other factors as it deems appropriate.
5. Parent and Guardian Obligations
5.1 Accompaniment and Supervision
Each minor child selected for a Program must be accompanied by a parent or legal guardian at all times during the duration of the trip. The accompanying parent or legal guardian assumes full and sole responsibility for the supervision, care, safety, and conduct of the minor child throughout the Program. Under no circumstances shall the Organization be responsible for the supervision of any minor child.
5.2 Compliance with Program Requirements
Once selected, each Participant and accompanying parent or guardian shall comply with all requirements, deadlines, and procedures established by the Organization, including but not limited to: providing required documentation (e.g., valid passports, travel documents, and identification); completing all required consent, waiver, and release forms; meeting any applicable deadlines for travel arrangements; and adhering to any rules of conduct established by the Organization.
5.3 Right to Withdraw or Decline
A parent or legal guardian has the right, at any time prior to travel, to: (a) withdraw any previously submitted application from consideration; and (b) decline acceptance of a selection if a minor is chosen for the Program. Any such withdrawal or declination shall be communicated to the Organization in writing. The Organization shall have no obligation or liability in connection with any such withdrawal or declination.
6. Organizational Rights and Discretion
The Organization reserves the right, in its sole and absolute discretion, to:
(a) adopt, amend, modify, or discontinue any policies, procedures, rules, or guidelines governing the Organization's operations, the Site, or the Programs;
(b) establish, modify, or terminate any Program at any time, with or without notice;
(c) adopt new programs, initiatives, or activities in furtherance of its mission;
(d) determine the number of Participants to be selected in any given year, including selecting none;
(e) set the amount of travel cost support to be awarded to each selected Participant;
(f) suspend or terminate any User's access to the Site for any reason; and
(g) take any other action it deems necessary or appropriate in furtherance of its mission and organizational objectives.
7. Third-Party Service Providers
The Organization may engage or rely upon third-party service providers, vendors, contractors, or partners (collectively, "Third-Party Providers") to support the Organization, the Site, and/or the Programs. Such Third-Party Providers may include, without limitation, website hosting services, payment processors, travel service providers, technology providers, and other vendors. The Organization does not guarantee, endorse, warrant, or assume any responsibility or liability for the acts, omissions, products, services, performance, or conduct of any Third-Party Provider. Any interactions, transactions, or disputes between a User or Participant and any Third-Party Provider are solely between such parties. The Organization shall not be a party to, and shall have no liability arising from or related to, any such interactions, transactions, or disputes. The Site may contain links to third-party websites or services. The Organization does not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party websites or services. Access to any third-party website or service is at your own risk.
8. Assumption of Risk and Release of Liability
By participating in any Program, each Participant and the parent or legal guardian of each minor Applicant acknowledges and agrees that travel involves inherent risks, including but not limited to risks associated with air travel, ground transportation, foreign travel, illness, injury, accident, loss of property, natural disasters, political instability, and other unforeseen events. Each Participant and parent or legal guardian voluntarily assumes all such risks. To the fullest extent permitted by applicable law, each Participant and the parent or legal guardian of each minor Applicant hereby releases, discharges, and holds harmless the Organization, its officers, directors, board members, employees, agents, volunteers, contractors, and representatives (collectively, the "Released Parties") from and against any and all claims, demands, actions, causes of action, liabilities, damages, losses, costs, and expenses (including attorneys' fees) arising out of or in any way related to participation in any Program, use of the Site, or any acts or omissions of any Participant, Third-Party Provider, or other person or entity.
9. Disclaimers
THE SITE AND ALL CONTENT, MATERIALS, INFORMATION, AND SERVICES PROVIDED ON OR THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE ORGANIZATION DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THE ORGANIZATION DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE ORGANIZATION MAKES NO WARRANTIES OR REPRESENTATIONS REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT OR INFORMATION ON THE SITE.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE RELEASED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR USE OF OR INABILITY TO USE THE SITE; (B) YOUR PARTICIPATION OR INABILITY TO PARTICIPATE IN ANY PROGRAM; (C) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON OR RELATED TO THE SITE OR ANY PROGRAM; OR (D) ANY OTHER MATTER RELATING TO THE SITE OR ANY PROGRAM, WHETHER BASED ON WARRANTY, CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE ORGANIZATION HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THE ORGANIZATION'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR ANY PROGRAM EXCEED THE AMOUNT OF FIFTY DOLLARS ($50.00).
11. Indemnification
You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Site; (b) your participation or your minor child's participation in any Program; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; or (e) any information you submit through the Site that is inaccurate, incomplete, or misleading.
12. Intellectual Property
All content, materials, trademarks, logos, trade names, and other intellectual property on the Site are the property of the Organization or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from the Site without the Organization's prior written consent.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any Program shall be resolved exclusively in the state or federal courts located in Cook County, Illinois, and you hereby consent to the personal jurisdiction and venue of such courts.
14. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.
15. Entire Agreement
These Terms, together with any other policies or agreements referenced herein, constitute the entire agreement between you and the Organization with respect to the subject matter hereof and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
16. Waiver
The failure of the Organization to enforce any provision of these Terms shall not constitute a waiver of such provision or any other provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of the Organization.
17. Modifications to These Terms
The Organization reserves the right, in its sole discretion, to modify, amend, or update these Terms at any time. Any modifications will be effective upon posting the revised Terms on the Site or upon such other form of notice as the Organization may provide. Your continued use of the Site, continued participation in any Program, or continued engagement with the Organization following the posting of any modifications constitutes your acceptance of and agreement to the modified Terms. It is your responsibility to review these Terms periodically. If you do not agree with any modification to these Terms, you must immediately discontinue use of the Site and withdraw from any Programs.
